Terms of Service
In short: BlueManager is a monthly or yearly subscription. You own your data, you can cancel any time, and you keep access until the end of the period you've paid for. We look after your data carefully and never sell it.
1. Who we are
BlueManager (“the Service”) is provided by Schalk Pieter van Staden, trading as Project Bluecollar (“we”, “us”, “our”), based in Pretoria, Gauteng, South Africa. Contact: [email protected], 061 593 9447.
These terms are an agreement between us and the business that signs up (“you”, “your company”). The person who signs up confirms they are allowed to accept these terms for that business.
2. The Service
BlueManager is online software for trade and service businesses to manage leads, quotes, invoices, supplier orders, scheduling, sign-offs and sales commission. It is provided “as is” over the internet. We may improve, change or add features from time to time; we won't remove a core feature you rely on without giving you reasonable notice.
3. Your account
- Your company gets its own company ID. You may add users up to your plan's limit (currently 10).
- You are responsible for everyone you give access to, for keeping passwords private, and for removing people who leave.
- Tell us straight away at [email protected] if you think someone has accessed your account without permission.
4. Free trial
New companies get a free trial (currently 14 days) with no card required. When the trial ends without a paid plan, your account becomes read-only: you can still view and download your information, but you can't create or change anything until you choose a plan.
5. Plans, prices and payment
- Monthly: R750 per month, charged to your card automatically each month through PayFast until you cancel.
- Yearly: R8 000 per year, paid in advance by card, Instant EFT or bank transfer.
- We are not registered for VAT, so no VAT is added. If that changes we'll tell you in advance how it affects your price.
- We may change prices with at least 30 days' written notice. A new price applies from your next billing period after the notice ends. Yearly plans keep their price until renewal.
- Payments are processed by PayFast. We never see or store your card details.
- If a payment fails or is late, you keep full access for 7 days. After that the account becomes read-only until payment is received. Nothing is deleted.
6. Cancelling and refunds
- You can cancel a monthly subscription at any time from Plan & billing in the app. You keep access until the end of the period you've paid for, and you won't be charged again.
- Yearly plans simply don't renew unless you pay for another year.
- We don't refund part-months or part-years, except where the law requires it. If you are a natural person (not a company) buying online, you may cancel within 7 days of your first payment for a full refund, as provided for in the Electronic Communications and Transactions Act.
7. Your data
- You own your data. This includes your clients, quotes, invoices, photos and documents (“Customer Data”). We only use it to provide the Service to you, and never sell it or use it for advertising.
- For Customer Data about your own clients, you are the “responsible party” under the Protection of Personal Information Act (POPIA) and we are your “operator”: we process it on your behalf and according to your instructions, and we keep it secure and confidential. You are responsible for having a lawful reason to collect your clients' information and for the messages you send them.
- You can download a full export of your Customer Data at any time from Plan & billing → Download all my data (a spreadsheet of everything, every quote and invoice as PDF, and all photos) — also after a trial ends or the account is closed.
- If your account is closed, or the trial or subscription ends without payment, we keep your data for 90 days so you can come back or download it, then delete it. We email the account owner 14 days before. Copies in our encrypted backups expire on their own within 12 months.
- How we handle personal information is explained in our Privacy Policy.
8. Acceptable use
You agree not to use the Service to break the law, send spam, harass anyone, upload malicious files, try to access another company's data, overload or attack the Service, or resell it without our written permission. We may suspend an account that does any of these things, and will tell you why unless the law prevents us.
9. Email and SMS
Quotes, invoices and messages you send from BlueManager are sent on your behalf. You are responsible for their content and for having your clients' permission where it's needed. SMS messages are sent through the SMS provider you connect, under your own account with them.
10. Availability and support
We work hard to keep the Service available and your data backed up daily, but we can't promise it will never be interrupted (for example during maintenance or problems with our hosting or internet providers). Support is available by email and WhatsApp, Monday to Friday, 08:00–17:00.
11. Limitation of liability
To the extent the law allows, we are not liable for indirect or consequential losses (such as lost profits or lost business), and our total liability to you for any claim is limited to the fees you paid us in the 3 months before the claim arose. Nothing in these terms limits liability that cannot be limited by law, including under the Consumer Protection Act where it applies.
12. Suspension and termination
You may stop using the Service at any time. We may suspend or close an account for non-payment (after the grace period above) or for a serious breach of these terms. If we ever decide to stop offering BlueManager, we'll give you at least 60 days' notice and a full export of your data.
13. Changes to these terms
We may update these terms. For important changes we'll notify account owners by email at least 30 days before they take effect. If you continue to use the Service after that, the new terms apply.
14. General
These terms are governed by the laws of the Republic of South Africa, and South African courts have jurisdiction. If any part of these terms is found unenforceable, the rest still applies.
